Can a HELOC or Second Mortgage Foreclose in Florida

Yes. A mortgage securing a home equity line of credit, or another second mortgage, can support a foreclosure action in Florida if the creditor establishes its entitlement to that relief. Being current on your first mortgage does not necessarily resolve a default on a separate loan secured by the same property.
Second lien does not mean no foreclosure risk
A second mortgage generally has a different priority from the first mortgage. Priority affects competing interests in the property; it does not by itself prevent the second mortgage holder from pursuing foreclosure. The documents, lien positions, and parties to the lawsuit need review. Do not assume the first loan’s status determines the outcome of a second-loan dispute.
Pay attention when a HELOC enters repayment
A HELOC may have a draw period followed by a repayment period, with different payment requirements. Review the agreement and notices explaining any change. If the payment increases or a maturity balance becomes due, address it before relying on the amount you paid previously. A modification of the first mortgage does not necessarily modify the HELOC.
Investigate an old or zombie second mortgage
Some homeowners receive demands on second mortgages after years of little or no collection activity. These are often called zombie second mortgages. A charge-off is not necessarily debt forgiveness or a release of the lien. Locate any satisfaction, settlement, cancellation, or modification records before concluding that the loan was resolved.
Review who is collecting and what is being demanded
Request appropriate documentation of the claimant’s identity, loan history, and claimed balance. Compare the demand with older statements and agreements. Questions may include whether interest and fees are authorized, whether required notices were provided, and whether the claimant can enforce the obligation. The absence of statements deserves investigation but does not automatically erase the mortgage.
Do not assume an old loan is automatically unenforceable
Limitations issues can depend on the loan terms, maturity, alleged defaults, acceleration history, and prior litigation. A lawyer should review the chronology before you acknowledge a disputed balance or sign a new agreement. Federal debt-collection restrictions may also matter when the collecting party and conduct fall within the statute.
Use the rules that apply to the particular loan
HELOCs are generally excluded from the mortgage-servicing provisions in Regulation X’s Subpart C. Do not assume the same federal Notice of Error or loss-mitigation procedures apply to every home-secured loan. Other contractual and legal rights may still be relevant.
