“Owned two properties: an investment property in foreclosure for a couple of years, and eventually Mr. Montalvo negotiated a release and waiver of deficiency. Primary home: defended the foreclosure, tried to obtain a modification, was denied four times, ended up going to trial, lost the trial. Entered a Chapter 13 plan under the new loan modification programs, was able to obtain a loan modification with forgiveness of principal, and eventually got out of bankruptcy having accomplished our main goal of obtaining a modification.”

“After being in foreclosure for about 3 years and a few loan modification denials, Mr. Montalvo requested that I file Chapter 13 bankruptcy and try the new loan modification program being offered in bankruptcy court. It was a success — I was able to obtain a favorable modification. I also had a second mortgage, and it was forgiven. Later I dismissed my bankruptcy case, as I accomplished all my goals.
