What to Do If Your Mortgage Servicer Misapplies Payments or Shows the Wrong Balance

If your mortgage statement shows a missed payment you believe you made, or a balance you cannot reconcile, start by preserving the records. An account error can affect fees, delinquency status, or the amount demanded in foreclosure. A careful comparison is more useful than repeated calls without a written record.
Compare the statement with proof of payment
Gather bank records, canceled checks, online confirmations, and receipts. Match the amount, date, and account number for each disputed payment. Review whether the servicer posted the money to a monthly installment, escrow, fees, or a suspense account. A payment being received and a payment being applied are different accounting events.
Identify the precise discrepancy
For example, your bank may show a payment cleared while the statement still identifies that installment as unpaid. Or a modification balance may differ from the amount used on later statements. Write a short chronology and identify the records supporting your position. Separate principal and interest from escrow, advances, and charges so the disputed amount is clear.
Use a written request suited to the problem
For covered mortgages, a Notice of Error identifies a servicing error and asks the servicer to investigate. A Request for Information seeks relevant records or explanations. Include identifying information and describe the issue specifically. If the servicer designates an address for these submissions, use that address. Keep the letter, attachments, and proof of delivery. A general customer-service email may not trigger the same duties.
Request the records needed to check the account
Depending on the dispute, useful records may include a payment history, transaction descriptions, suspense activity, escrow analyses, and an itemization of charges. Ask focused questions tied to the discrepancy. Federal rules establish response procedures with differing deadlines and exceptions; a request does not guarantee access to every document.
Review the response and preserve any resulting harm
Check whether the response actually explains the disputed transaction. Save later statements and any collection communications. Preserve evidence of additional fees, rejected payments, out-of-pocket expenses, or other effects. A potential legal claim depends on the applicable law, the conduct, and the available evidence. An incorrect balance alone does not establish every element of a damages claim.
Keep court deadlines in view
Do not assume a servicing dispute suspends payment obligations, hearings, or foreclosure deadlines. Coordinate the written investigation with any pending lawsuit.
